1. Definitions
“Jetty Health,” “we,” “us,” “our”: Jetty Health, Inc., including its employees, officers, directors, agents, contractors, affiliates, subsidiaries, successors, and assigns.
“User,” “you,” “your”: Any individual who accesses or uses our website, app, or services.
“Services”: Any services, data, content, products, features, or functionality provided or made available by Jetty Health, including digital dashboards, AI-powered features, recommendations, educational materials, and any subscription-based offerings.
“Personal Information”: Information that identifies or relates to you, as further described in our Privacy Policy (including health-related info, contact details, and payment data).
“Third-Party Providers”: Independent vendors including AI service providers not owned or controlled by Jetty Health.
2. Acceptance & Scope
By clicking creating an account, or otherwise acknowledging acceptance (including by using the Services), you confirm that you have read, understood, and agree to these Terms in their entirety. These Terms apply to U.S. residents. If you are located outside the United States, you are solely responsible for complying with local laws applicable to you.
3. Eligibility & Age Requirements
You must be 18 years of age or older to use Jetty Health. We do not knowingly collect data from or provide services to minors. If we learn that a user under 18 is accessing our Services, we may delete their data and terminate Services in accordance with applicable law.
4. Nature of Our Services & Third-Party Providers
Jetty Health provides digital health and wellness tools, including AI-powered summaries and insights. Jetty Health is not a healthcare provider, laboratory, or medical device. Third-party providers that Jetty uses are fully independent, and Jetty Health is not responsible for their actions, errors, or omissions.
5. User Responsibilities & Prohibited Activities
You agree to:
Use Jetty Health lawfully, for your personal, non-commercial use.
Provide accurate, up-to-date information during registration and maintain its accuracy.
Safeguard your password and account; any actions under your credentials will be attributed to you.
Follow any instructions for using Jetty Health’s features.
You must not:
Violate any law or regulation.
Introduce viruses, malware, or other harmful code.
Attempt to gain unauthorized access to any part of Jetty Health, servers, or networks.
Harvest, collect, or store personal information about other users without explicit permission.
Use bots, scrapers, or other automated means to access or collect information from Jetty Health.
Copy, modify, distribute, sell, reverse engineer, decompile, or disassemble any part of Jetty Health except where permitted by law.
6. No Medical Advice or Doctor-Patient Relationship
All data and any content provided by Jetty Health is for general informational purposes only... Always seek advice from a qualified healthcare professional for specific medical questions or treatment decisions. You acknowledge that output from AI systems can be inaccurate, incomplete, or contain errors, and you agree not to rely on any information from the Services without independent verification.
7. Privacy & Data Security
Your personal and health-related information is governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using Jetty Health, you consent to these practices. Jetty Health is not a covered entity under HIPAA. We aim to comply with state privacy laws. See our Privacy Policy for how to exercise any applicable rights.
8. Intellectual Property & User Content
All Jetty Health content, software, logos, text, images, and designs are owned or licensed by Jetty Health and protected by intellectual property laws. Jetty Health grants you a non-exclusive, revocable, non-transferable license to access Jetty Health for your personal use, subject to these Terms. If you submit reviews, comments, or other content, you grant Jetty Health a worldwide, royalty-free, irrevocable, perpetual license to use, reproduce, display, adapt, and distribute it in any media. To the extent legally permissible, you waive any moral rights in your submitted content.
9. Limitation of Liability
To the fullest extent allowed by law, Jetty Health is not liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits or emotional distress. Our maximum aggregate liability for any claim is limited to $100.
10. Indemnification
You agree to defend, indemnify, and hold harmless Jetty Health, its officers, employees, contractors, and agents from all claims, demands, losses, liabilities, or expenses (including attorneys’ fees) arising out of or related to:
Your breach of these Terms or applicable law.
Your misuse of Jetty Health.
Your violation of any third-party rights (including privacy, intellectual property, or publicity).
11. User Content Moderation & Third-Party Links
Jetty Health reserves the right (but not the obligation) to remove or modify any user-posted content that violates these Terms or the law. Jetty Health may link to external websites that are not controlled by Jetty Health. We are not responsible for their content, policies, or actions.
12. Termination
By You: You may stop using Jetty Health at any time. To delete or deactivate your account, email support@myjettyhealth.com. By Jetty Health: We may suspend or terminate your account if you violate these Terms or engage in unlawful, fraudulent, or abusive behavior. We will attempt to notify you unless legally restricted.Upon termination, all licenses granted to you in these Terms end immediately. Any provisions regarding liability, indemnification, arbitration, intellectual property, or any terms that by their nature should survive will remain in effect.
13. Dispute Resolution & Arbitration
These Terms are governed by Delaware law.
Any dispute with Jetty Health will be resolved by binding arbitration (not in court), except where prohibited. You agree to resolve disputes individually, not as part of a class action. If many similar arbitration claims are filed, Jetty Health may request they be handled together. You can opt out of arbitration within 30 days of first using Jetty Health by emailing support@myjettyhealth.com with your name and “I opt out of arbitration.”
You or Jetty Health may bring small claims or seek court orders for intellectual property or confidentiality issues. If any part of this section is unenforceable, the rest still applies.
14. Compliance with Laws & Export Controls
You agree to comply with all relevant U.S. laws, regulations, and export controls. You represent you are not located in or a citizen of any restricted or embargoed country.
15. Severability, Entire Agreement & Waiver
If any term in these Terms is held invalid by a court of competent jurisdiction, that term shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect. These Terms (plus referenced policies like the Privacy Policy) form the entire agreement between you and Jetty Health regarding your use of Jetty Health. No other oral or written statements modify this Agreement. Failure to enforce any provision of these Terms does not constitute a waiver of that provision unless stated in writing.
16. Periodic Review & Modifications
Jetty Health may amend these Terms from time to time to reflect changes in business practices, science, laws, or regulations. We will update the Effective Date and post revised Terms. Continuing to use Jetty Health after an update indicates acceptance of the new Terms.
